Terms of Service

These terms govern your use of BeyondSwipe, an application operated by 15748666 Canada Inc. ("BeyondSwipe", "we", "us", or "our"), incorporated under the laws of Canada. By creating an account or using BeyondSwipe (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms. Material changes will be communicated with 30 days' notice. Continued use of the Service after the effective date constitutes acceptance.

You must be at least 18 years of age to use BeyondSwipe. By using the Service, you represent and warrant that:

• You are 18 years of age or older.
• You are legally capable of entering into binding contracts in your jurisdiction.
• You are not prohibited from using the Service under applicable laws.
• You have never been convicted of, and are not required to register as a sex offender in connection with, any sexual offence. Persons required to register as sex offenders in any jurisdiction are prohibited from using BeyondSwipe.
• You have not previously been permanently banned from BeyondSwipe.

We reserve the right to terminate any account where we discover the user is under 18, with immediate effect and without refund.

All users are required to complete identity verification through Didit, our identity verification provider, before accessing the full Service. Verification requires:

• Payment of a one-time $4 verification deposit, charged in your local currency through the app store you signed up on. The deposit includes up to three completed verification submissions for the same account. An interrupted session or provider error does not count as a completed submission.
• Live capture of a government-issued photo identification document issued in the United States or Canada, being a passport, driver's license, state or provincial identity card, or residence permit, submitted directly to Didit. The document must be issued in one of those countries; your own nationality is not a requirement.
• Completion of a real-time selfie, which Didit matches biometrically against your document.

Verification is performed by Didit. Your identification document and selfie are transmitted directly to Didit and are never received by, transmitted through, or stored on BeyondSwipe's systems. We send Didit the date of birth you entered so it can compare that exact date with the date printed on your document. We request exactly one detail Didit extracts from your document: that printed date of birth, read transiently to confirm you are 18 or older and that it matches your declaration, then immediately discarded without being stored or logged. We do not request your legal name, document number or address. Beyond that check we receive a result, a session reference, and non-identifying warning codes needed to explain a refusal. After any verification resolves, whether approved or declined, we instruct Didit to delete the underlying document and selfie. Didit's handling of this data is governed by Didit's terms and privacy policy. Failure to pass verification results in denial of service, and we do not have the ability to override Didit's document, liveness, or face-match decisions.

Scope of verification. Verification confirms only that a member presented a genuine government-issued identity document and that their live selfie matched the photograph on that document. It is not a criminal record check, background check, or screening against any offender registry, and it is not a representation or warranty by us as to any member's character, honesty, marital status, intentions, or safety. Statements made by members in their profiles are self-reported and are not verified by us. You must not treat a verified badge as an assurance of safety. Biometric consent. The selfie check involves the processing of biometric information (facial geometry) by Didit for the sole purpose of confirming that you match your identification document. We provide notice of this before capture and you must consent to it in order to verify. You may decline, in which case you will be unable to complete verification and will not be able to access member-to-member features. Our account is set to a one month retention period, the shortest the platform offers, and biometric templates are deleted together with the verification session rather than kept for later matching. You may withdraw your consent to that retention at any time by writing to privacy@beyondswipe.app, after which we will instruct Didit to delete it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and truthful information when creating your account.
• Keep your profile information current and honest.
• Notify us immediately of any unauthorised access to your account at support@beyondswipe.app.
• Not share your account with any other person.
• Maintain only one active BeyondSwipe account.

Incorporated policies. The following policies form part of these Terms and are incorporated into them by reference. Breaching any of them is a breach of these Terms and may result in suspension or permanent termination of your account without refund: our Community Guidelines, our Dating Safety & Anti-Scam Policy, our Integrity Policy, our Privacy Policy, and our Promotion Terms.

You agree to use BeyondSwipe only for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent content.
• Impersonate any person or entity.
• Post or transmit any content that is harassing, abusive, threatening, hate-based, defamatory, obscene, or pornographic.
• Upload, share, or distribute child sexual abuse material (CSAM) or any sexual content involving minors. Violation of this prohibition will be immediately reported to police and to the Canadian Centre for Child Protection through Cybertip.ca, the agency designated under Canadian law for a service operated from Canada.
• Use the Service for commercial solicitation, advertising, or spam.
• Attempt to gain unauthorised access to any part of the Service or another user's account.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools (bots, scrapers, scripts) to access or interact with the Service.
• Interfere with or disrupt the integrity or performance of the Service.

You retain ownership of the content you post on BeyondSwipe (photos, bio, messages). By posting content, you grant BeyondSwipe a limited, worldwide, royalty-free licence to host, store, and display your content solely for the purpose of operating and providing the Service.

You represent and warrant that:

• You own or have the rights to all content you upload.
• Your content does not infringe any third party's intellectual property, privacy, or publicity rights.
• Your photos accurately represent you and are not deceptive.

Photos are screened before publication by AWS Rekognition for prohibited content and by Microsoft PhotoDNA against industry databases of known child sexual abuse material. Video intros and voice recordings are screened too: still frames sampled from a video go through the same image check, and a voice recording is transcribed and the resulting text checked for prohibited content. Publication is refused if screening cannot run. Content that fails screening is blocked and flagged for manual review.

Suspected child sexual abuse material is reported to the Canadian Centre for Child Protection through Cybertip.ca, the agency designated under Canadian law for a service operated from Canada, and to police where we have reasonable grounds to believe our service has been used to commit an offence. After identity verification, your account is on the free tier by default, which includes:

• 10 Connect actions per day (likes / interests expressed).
• 3 open matches. A further match is shown blurred and locked unless you subscribe.
• 5 messages per match, after which that conversation is locked.
• No voice notes in chat.
• No read receipts.

Deleting your account does not cancel your subscription. Subscriptions are sold and billed by the app store you purchased through, and only the account holder can cancel one, from that store's own subscription settings. We are not able to cancel it for you. If you delete your BeyondSwipe account while a subscription is active, the store will continue to charge you until you cancel it there. Deletion does not refund the current billing period.

BeyondSwipe+. A BeyondSwipe+ subscription at $14 a month removes those limits: unlimited Connect actions, unlimited open matches, unlimited messages, voice notes in chat, and read receipts.

No free trial. There is no trial period. After verification your account stays on the free tier described above for as long as you keep it, and a subscription is optional.

Automated content screening. BeyondSwipe uses the Anthropic Claude API to check the transcript of a voice recording for prohibited content before that recording is published. It reads what was said in a recording you upload, and it is not used to write or suggest messages. Your data is not used to train AI models.

Paid subscriptions are available to unlock unlimited Connect actions and messaging. Subscription fees are billed in advance on a recurring basis. You may cancel at any time; your subscription will remain active until the end of the current billing period. No partial refunds are issued for unused subscription time, except where required by applicable consumer protection law.

The $4 verification deposit is charged once per account and includes up to three completed submissions. Retrying an included submission does not create another charge. The deposit is non-refundable once verification has begun, except where applicable law or the app store's rules require otherwise, or where a duplicate or erroneous charge must be corrected. If all three included submissions are used without a successful result, the deposit is not refunded: it pays for the checks themselves, which are carried out and charged to us whether or not they succeed.

BeyondSwipe may offer promotional pricing and early-bird discounts from time to time. Full terms for active promotions are available on the Promotion Terms page.

All payments are processed by our payment provider, and by making a payment you agree to that provider's terms of service. We do not store your payment card details. You authorise us to charge the applicable fees to your payment method on file for subscription renewals.

We reserve the right to change subscription pricing with 30 days' advance notice. Price changes do not apply to active subscription periods already paid.

BeyondSwipe is a platform for genuine personal connections. The following interactions are prohibited and may result in immediate account termination:

• Soliciting money or financial assistance from other users.
• Engaging in escort, sex work solicitation, or trafficking in persons.
• Sharing another user's personal information without their consent ("doxing").
• Contacting users who have blocked or unmatched you through any other means.
• Recording or screenshotting private conversations without consent, where such consent is required by applicable law.

We reserve the right to remove any content and to suspend or permanently terminate any account that violates these Terms, at our sole discretion, with or without notice. We are not obligated to monitor all user content but will act on reports brought to our attention.

If your account is suspended or terminated for a Terms violation, you will not receive a refund of any subscription fees. The $4 verification deposit is not refunded on account termination, on the same basis set out in section 7.

You may report content or users that violate these Terms at support@beyondswipe.app. CSAM reports are handled through our mandatory reporting process and are never dismissed without escalation to law enforcement.

The BeyondSwipe name, logo, product design, code, and all associated materials are the exclusive property of 15748666 Canada Inc. and protected by Canadian and international intellectual property laws. You may not use our trademarks, logos, or trade dress without our prior written consent.

Copyright complaints (DMCA). BeyondSwipe respects intellectual property rights. If you believe content on the Service infringes your copyright, send a takedown notice to support@beyondswipe.app including: identification of the copyrighted work, the location of the infringing material, your contact information, a statement of good-faith belief that the use is unauthorised, and a statement, under penalty of perjury, that the information is accurate and you are the owner or authorised to act for the owner. We will remove infringing content and may terminate the accounts of repeat infringers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS. IDENTITY VERIFICATION CONFIRMS A USER'S REAL IDENTITY BUT DOES NOT GUARANTEE THEIR INTENTIONS, CHARACTER, OR PAST CONDUCT. ALWAYS EXERCISE PERSONAL SAFETY PRECAUTIONS WHEN MEETING OTHER USERS IN PERSON.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEYONDSWIPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BEYONDSWIPE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 CAD.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You agree to indemnify and hold harmless BeyondSwipe, its officers, directors, employees, and agents from and against any claims, damages, losses, and costs (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you post on the Service.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service will be resolved through good-faith negotiation first. If negotiation fails, disputes will be submitted to binding arbitration administered by ADR Chambers in Toronto, Ontario, under its commercial arbitration rules. The arbitration will be conducted in English. Nothing prevents either party from seeking injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

Notwithstanding the above, Quebec residents may bring claims before the courts of Quebec and benefit from the protections of the Consumer Protection Act (Quebec).

You may delete your account at any time through the app settings or by emailing support@beyondswipe.app. Deletion is permanent and irreversible.

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 6, 11, 12, 13, 14, and 15 survive termination.
